Opinions on Promoting the Demonstration and Application of the First Major Technical Equipment

To the people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government, relevant departments and directly affiliated institutions of the State Council:
Major technological equipment is a vital tool of the country, which is related to comprehensive national strength and national security. The first major technological equipment (hereinafter referred to as the "first set") refers to the equipment products that have achieved significant technological breakthroughs, owned intellectual property rights, and have not yet achieved market performance in China, including the first three sets or batches of complete equipment, complete equipment and core components, control systems, basic materials, software systems, etc. In order to implement the decisions and deployments of the Party Central Committee and the State Council on promoting supply side structural reform, implementing innovation driven development strategy, and building a strong manufacturing country, taking the first set of demonstration applications as a breakthrough point, and promoting the overall improvement of major technological equipment level, with the approval of the State Council, the following opinions are proposed.
1、 Overall requirements
(1) Guiding ideology.
(2) Basic principles.
Adhere to the combination of government guidance and market mechanisms. Fully leverage the role of government departments in top-level design, public services, and institutional supply, and strive to eliminate market failures caused by information asymmetry; Adhere to the dominant position of enterprises, respect market laws, and fully mobilize the enthusiasm of various market entities to participate in major technological equipment innovation.
Adhere to the combination of policy incentives and institutional guarantees. Intensify policy support, strengthen policy connections in science and technology, industry, finance, insurance, military civilian integration, etc., and build a policy system conducive to the first set of demonstration applications; Clarify the requirements of relevant laws and regulations such as bidding, establish a guarantee mechanism conducive to the first set of demonstration applications, and create an atmosphere that encourages innovation, allows trial and error, and tolerates failure.
Persist in combining supply enhancement with demand pull. Improve the foresight and pertinence of major technological equipment research and development plans, fill in the gaps in inspection, testing, and public services, and enhance the supply capacity and market recognition of the first set of products; Based on major national strategies, we will conduct in-depth analysis of industrial development trends and market demand, strengthen the supply and demand docking of the first set of products, and form a pattern of mutual promotion and positive interaction between market demand and research and development demonstrations.
Adhere to the combination of key breakthroughs and coordinated promotion. Focus on key areas of national economy, people's livelihood, and national security, determine the main direction of innovation and development of major technological equipment and the first set of demonstration applications, and implement key breakthroughs; Give full play to the enthusiasm of localities and industries, adapt measures to local conditions, implement policies according to different industries, and jointly promote the first set of demonstration applications in advantageous and characteristic fields, comprehensively enhancing the support capacity of major technological equipment for economic development.
(3) Main objective.
By 2020, the innovation system for major technological equipment research and development, the first set of testing and evaluation system, the demonstration application system, and the policy support system will be fully formed, and the guarantee mechanism will be basically established. By 2025, the comprehensive strength of major technological equipment will basically reach the international advanced level, effectively meeting the needs of economic development and national security.
2、 Improve the R&D and innovation system for major technological equipment
(4) Identify key areas for major technological equipment innovation.
According to national strategic and application needs, compile a catalog of major technological equipment innovation, determine research and development priorities and timelines. Strengthen the tracking and evaluation of directory execution, and implement dynamic adjustments. Based on the key areas identified in the directory, we will focus on implementing existing projects related to major technological equipment in the national science and technology major projects and key research and development plans. In the upcoming major projects and key research and development plans of Science and Technology Innovation 2030, we will further strengthen the research and development of major technological equipment.
(5) Build a major technology equipment research and development innovation platform.
Relying on large technology enterprise groups and key research and development institutions, establish a major technology equipment innovation research institute, facing the direction of intelligent, green, and service-oriented development, strengthen the top-level design of major technology equipment innovation, and build a major technology equipment innovation system. On the basis of national science and technology innovation bases such as State Key Laboratory, engineering research centers, technology innovation centers, clinical medical research centers, etc., a key common technology R&D platform for major technical equipment will be formed, and superior resources in related fields will be gathered to enhance R&D and innovation capabilities.
(6) Strengthen cooperation in research and innovation of major technological equipment.
Establish a major technology and equipment R&D innovation alliance involving research institutes, manufacturing enterprises, industry associations, etc., enhance the strength of innovation entities, and promote collaborative cooperation among various innovation entities. Establish a collaborative mechanism between industry, academia, research, and application that complements each other's strengths, shares risks, and benefits, closely focuses on application needs, strengthens the connection between research and application, and accelerates the demonstration and application of innovative achievements. Support R&D, manufacturing, and user units to cooperate in establishing major technical equipment pilot bases, and build a bridge between product development and demonstration applications.
(7) Establish a sound guidance mechanism for mass innovation of major technological equipment.
Develop guidelines for mass innovation and research and development of major technological equipment, release research and development needs to the society, leverage various innovative models such as mass innovation, crowdfunding, crowdsourcing, and virtual innovation and entrepreneurship communities, gather various innovative elements, and guide innovation entities such as small and medium-sized enterprises to participate in the research and development of major technological equipment. Strengthen the evaluation of crowdsourcing achievements and supply-demand docking, and promote the transformation of achievements.

3、 Establish a sound first set of testing and evaluation system
(8) Standardize the evaluation and management of the first set.
Develop a first set evaluation method, clarify the definition, standards, and scope of the first set, and establish evaluation procedures such as application, acceptance, evaluation, publicity, and release to ensure that the evaluation process is open, fair, and just. Based on the actual development of the industry, determine the validity period of the first set evaluation, regularly release and dynamically adjust the first set product catalog that has passed the evaluation, as the basis for demonstration applications.
(9) Establish the first set of evaluation institutions.
Relying on major technology and equipment innovation research institutes, industry associations, and inspection and testing institutions, fully utilizing existing facilities and platforms, establish the first set of evaluation institutions. The evaluation agency carries out its work based on the first set of evaluation methods. Develop the first set of management measures for evaluation institutions, clarifying the scope of responsibilities, testing and evaluation capabilities, and other requirements of the evaluation institutions. According to the principle of "double random, one open", strengthen in-process and post event supervision, and enhance the credibility of evaluation institutions.
(10) Enhance the first set of testing capabilities.
According to the requirements for testing and evaluation of the first set of equipment, strengthen the construction of State Key Laboratory, engineering research center, technology innovation center, manufacturing innovation center, quality inspection center, industrial measurement and testing center, improve relevant standards, measurement, inspection and testing methods and certification system, and improve inspection and testing capabilities. Accelerate the construction of production testing lines in industries with prominent online testing needs, such as process industries, to comprehensively and systematically test the quality, safety, environmental protection, reliability, and other aspects of the first set of products.

4、 Build the first demonstration application system
(11) Establish the first demonstration application base.
Based on major engineering construction and qualified industry backbone enterprises, establish the first set of demonstration application bases as a platform for long-term undertaking the first set of demonstration application tasks in related industries. Coordinate the construction of demonstration application bases and the implementation of development plans in related fields, optimize the layout of demonstration application bases. Strengthen the management and evaluation of demonstration application bases, and adjust the layout of the bases in a timely manner.
(12) Establish the first demonstration application alliance.
Based on industry associations and leading enterprises, establish the first set of demonstration application alliances involving users, engineering design, equipment sets, research and development, manufacturing, testing and other units, and build a supply and demand docking platform. Encourage the formation of demonstration application consortia and the construction of demonstration application production lines through joint ventures and cooperation. Utilize the integrated role of engineering companies and equipment suppliers, and develop and implement the first set of demonstration application plans based on research and usage requirements.
(13) Evaluate the effectiveness of the first set of demonstrations.
Organize the first set of evaluation institutions and other units to evaluate the demonstration effect of the first set in accordance with the principles of objectivity, truthfulness, openness, transparency, and scientific quantification, summarize experience, analyze problems, and propose improvement measures. Evaluation opinions can be used as a basis for standard revision, insurance claims, evaluation and evaluation, recognition and rewards, etc.

5、 Promote the integration and development of dual-use technologies and equipment for military and civilian use
(14) Accelerate the conversion of advanced military technology to civilian use.
Strengthen the connection between the "Catalogue for Promoting the Conversion of Military Technology to Civilian Use", the "Catalogue for the Conversion of National Defense Science and Technology Industry Intellectual Property Rights" and the Catalogue for Major Technological Equipment Innovation, and coordinate the promotion of "military to civilian use" related work. Gradually expand the opening of military research facilities such as key national defense science and technology laboratories and national defense science and technology industry innovation centers to civilian units. Accelerate the transformation of military scientific and technological achievements through joint incubation, patent transfer, technology investment, and intellectual property custody.
(15) Expand the channels for civilian enterprises to participate in military product development.
Starting from the actual needs of military product development, actively and steadily promote the relevant work of "civilian military service", promote the participation of civilian enterprises in military product development and supporting through reforms such as military equipment procurement system and pricing mechanism, and encourage military enterprises to carry out the first set of demonstration applications.
(16) Build the first set of R&D and demonstration application cooperation platform.
Establish a consultation mechanism and cooperation platform for the development and demonstration application of the first dual-use military civilian technology and equipment, study and promote major issues such as innovation, achievement transformation, exchange and cooperation, and demonstration application of dual-use technology and equipment, and organize the implementation of the first dual-use demonstration application project and engineering.

6、 Strengthen the application and protection of the first set of intellectual property rights
(17) Optimize the layout of intellectual property rights.
Priority examination support will be given to the core key patent applications of the first set of products in accordance with the law, to improve the quality and efficiency of examination, enhance the timeliness of authorization and the stability of patent rights. Strengthen the strategic layout of intellectual property rights for the first set of products and technologies, and prevent intellectual property risks. Accelerate the cultivation of high-value patents around the first set of industrial and value chains. Encourage intellectual property professional service institutions to strengthen their first set of intellectual property services.
(18) Promote the sharing of intellectual property achievements.
According to the principle of risk sharing and benefit sharing, encourage the lawful sharing of intellectual property achievements of enterprises in the development, system integration, demonstration application, and other aspects of the first set. Promote the construction of major technology and equipment patent pools, guide the establishment of intellectual property alliances in key areas, and strengthen cooperation, exchange, and collaborative innovation.
(19) Strengthen intellectual property protection.
Focusing on major technological equipment, and based on the first set of product catalogs that have been evaluated, we will further increase our efforts in intellectual property law enforcement and cracking down on intellectual property infringement and counterfeiting. Improve the diversified resolution mechanism for intellectual property disputes and explore intellectual property arbitration and mediation in key areas such as major technological equipment.

7、 Increase financial support
(20) Strengthen support for research and innovation in major technological equipment.
Through the central government's science and technology plans (special projects, funds, etc.), we will coordinate and support the research and development of major technological equipment and related common technologies that meet the conditions. For crowdsourcing achievements that meet the guidelines for major technological equipment, have been evaluated and reached the world's advanced level, and have filled the domestic gap, we encourage them to accelerate the transformation and application of their achievements.
(21) Focus on supporting the construction and operation of public platforms.
Fully utilize existing funding channels, increase support for the first set of related public platforms, and focus on promoting the construction and operation of major technology equipment innovation research institutes, key common technology research and development, and testing and evaluation institutions.
(22) Actively support demonstration application bases and projects.
Utilize industrial investment funds and other channels to support the construction of the first set of demonstration application bases and demonstration application projects. We will increase support for demonstration application bases with complete infrastructure, standardized comprehensive services, and significant operational effects, as well as the first set of innovative and important demonstration application projects.

8、 Strengthen the guidance of tax policies
(23) Implement current tax incentives policies.
For enterprises engaged in the research and development and manufacturing of major technological equipment, they shall enjoy the preferential pre tax deduction of enterprise income tax in accordance with the current tax policies. If they are recognized as high-tech enterprises, the enterprise income tax shall be levied at a reduced rate of 15%. Enterprises that purchase their first set of products that meet the current tax policy conditions shall enjoy tax incentives such as tax credits and accelerated depreciation of fixed assets in accordance with regulations.
(24) Adjust relevant import tax policies.
According to the development of the industry, adjust the "Guiding Catalogue for Industrial Structure Adjustment". Based on the research and development, manufacturing, and demonstration application of the first set, taking into account domestic industrial demand, dynamically adjust the "Catalogue of Imported Goods Not Exempted from Tax for Domestic Investment Projects" and "Catalogue of Imported Goods Not Exempted from Tax for Foreign Investment Projects" under the "Notice of the State Council on Adjusting the Tax Policy for Imported Equipment" (Guofa [1997] No. 37).

9、 Optimize financial support and services
(25) Develop financial leasing business.
Implement the development requirements of the financial leasing industry, vigorously promote the use of leasing agents, installment payments, and other methods, improve the market-oriented pricing mechanism for leasing the first set of products, and promote the demonstration application of the first set through financial leasing. Encourage conditional financing leasing and financial leasing companies to establish their first leasing department or specialized subsidiaries to better meet the financing leasing needs of key areas such as first leasing.
(26) Strengthen bank credit support.
Encourage commercial banks with conditions to establish the first set of green channels for enterprise and project loans, build a specialized credit evaluation system that combines internal and external ratings, optimize approval procedures, improve approval efficiency, and actively carry out business such as patent pledge and accounts receivable pledge. Encourage development oriented and policy oriented financial institutions to provide loan support for eligible first set demonstration application projects within their business scope.
(27) Expand direct financing channels.
Relying on a multi-level capital market system, support the first eligible set of enterprise asset securitization. Meet the financing needs of enterprises through corporate bonds, corporate bonds, short-term financing bonds, medium-term notes, perpetual notes, non-public targeted financing tools, and other means. For the first set of enterprises applying for bond issuance, it will be included in the existing policy support scope, simplifying the review process and improving review efficiency. Give full play to the role of advanced manufacturing industry investment funds, national emerging industry venture capital guidance funds, etc., actively attract social capital to participate in the research and development, manufacturing, and demonstration application of the first set.

10、 Enhance the stabilizing effect of insurance
(28) Continue to implement the first insurance compensation policy.
Summarize the experience of the first set of insurance compensation pilot work, refine and dynamically adjust the guidance catalog for the promotion and application of the first set according to national development strategies and market needs. Closely monitor the progress of the pilot program, provide policy explanations and promote public opinion, actively create a favorable policy environment and social atmosphere, and attract more enterprises to participate.
(29) Optimize the operation mechanism of the first set of insurance.
Optimize the operation mode and mechanism of the insurance company's co insurance system, and improve the dynamic adjustment mechanism that can be in and out. Optimize the accident liability identification process, establish and improve a fast track for claims, accumulate relevant insurance data, continuously optimize insurance plans, and provide high-quality services.
(30) Encourage local and insurance institutions to actively explore.
Encourage localities with conditions to independently research and formulate insurance compensation policies based on their industrial foundation and characteristics, and distinguish and connect them with the first set of insurance compensation policies in the country. Encourage insurance institutions to innovate insurance types and expand coverage beyond the first set of central and local insurance compensation policies based on market demand.

11、 Give full play to the role of state-owned enterprises
(31) Implement the responsibilities of state-owned enterprises.
Give full play to the backbone and exemplary role of state-owned enterprises in implementing the innovation driven development strategy and the strategy of building a strong manufacturing country, and enhance their ability to guarantee the innovation and development of major technological equipment. Vigorously promote and actively support state-owned enterprises to participate in the construction of key common technology research and development platforms, testing and evaluation institutions, first set of demonstration application bases, demonstration application alliances, etc., and actively adopt the first set of products.
(32) Improve the assessment and evaluation system.
Strengthen the assessment of state-owned enterprises serving national strategies, safeguarding national security, developing forward-looking strategic industries, and completing special tasks in important industries and key areas that are crucial to the lifeline of the national economy. Include the development and demonstration application of the first set in the special items list as an important reference basis in performance evaluation.
(33) Establish a fault-tolerant mechanism.
Develop a policy of tolerance for errors in the first set of demonstration applications, reasonably define and appropriately exempt the administrative, economic, safety and other responsibilities of relevant enterprises and responsible persons, fully mobilize and protect the enthusiasm of the first set of applications, and create a good environment and atmosphere that supports innovation.
(34) Enhance innovation demonstration capability.
Around the innovation chain of major technological equipment, guide and encourage state-owned enterprises or other ownership enterprises to accelerate mergers and acquisitions with capital as the link. Through strong alliances, complementary advantages, horizontal expansion, and vertical extension, vigorously cultivate large enterprise groups that integrate research and development, manufacturing, engineering design, system integration, and construction and operation, and enhance the demonstration capability of major technological equipment innovation.

12、 Clear legal requirements
(35) Implement requirements related to safeguarding national security.
According to the relevant provisions of the National Security Law, we will further strengthen the construction of innovation capabilities for major technological equipment, accelerate the development of independent and controllable strategic high-tech and core key technologies in important fields. Actively carry out and vigorously support the research and development, manufacturing, and demonstration application of the first set of products in key industries, major infrastructure, major construction projects, and other key areas that are related to the lifeline of the national economy, and encourage the use of the first set of products. Strengthen security reviews of key technologies, equipment products, and services that affect or may affect national security, effectively prevent and resolve security risks.
(36) Strictly implement bidding regulations and policies.
According to the first set of product catalog that has passed the evaluation, the project unit shall, in accordance with Article 41 of the Tendering and Bidding Law, adopt the comprehensive evaluation method for bidding and procurement of products of the same type. When bidding for the first set of products, the bidding unit shall not propose requirements such as market share or usage performance, and shall not exceed the actual needs of the bidding project or apply specific product evaluation standards, technical parameters, etc. For the first set of products that have already been insured, there is generally no need to charge a quality guarantee deposit. For the behavior of the tenderer or bidding agency restricting or excluding the first set of bidding under unreasonable conditions, administrative supervision departments at all levels shall strictly investigate and punish according to Article 51 of the Tendering and Bidding Law and other provisions, and hold corresponding legal responsibilities in accordance with the law.
(37) Increase support for government procurement and other measures.
Establish a sound government procurement policy that prioritizes the use of innovative products, and purchase innovative products such as the first set through methods such as first purchase and ordering, to promote the research and demonstration application of the first set of products. Other projects using state-owned funds are encouraged to purchase the first set of products in accordance with government procurement requirements.

13、 Establish and implement a safeguard mechanism
(38) Strengthen organizational and implementation leadership.
The National Development and Reform Commission and relevant departments shall coordinate, organize, implement, supervise and evaluate the first set of demonstration applications. All relevant departments shall adopt practical and effective policy measures in accordance with their respective responsibilities, and ensure the implementation of work tasks. Provincial governments should organize and implement the first set of demonstration applications in their respective regions based on local conditions.
(39) Improve supporting policies and measures.
According to the overall requirements and key tasks of the first set of demonstration applications, relevant functional departments will take the lead and participate in the improvement of relevant supporting policies and measures. As soon as possible, formulate and issue implementation plans to promote the research and development innovation, testing and evaluation, and demonstration application system construction of major technological equipment, promote the implementation rules or policy measures of military civilian integration, intellectual property, funds, finance, insurance, state-owned asset supervision, etc. for the first set of demonstration applications, and do a good job in interpreting and interpreting relevant laws and regulations such as national security and bidding.
(40) Strengthen supervision, inspection, and evaluation.
All relevant departments should strengthen the supervision, inspection, tracking and analysis of policy implementation and execution, conduct third-party evaluations in a timely manner, and report important work progress, existing problems and other situations in a timely manner. Conduct in-depth investigation and research on new situations and problems that arise, listen extensively to opinions, timely propose solutions, and continuously improve the first set of demonstration application policies.
(41) Establish a consultation guarantee mechanism.
Relying on relevant units, strengthen strategic planning and policy research related to the first set of demonstration applications. Give full play to the role of relevant industry associations (societies) and consulting agencies, interpret and promote policies, timely reflect problems in demonstration applications, and propose policy recommendations. By utilizing modern information and network technology, we will build the first set of demonstration application information service platforms, track and study the development trends of major technological equipment at home and abroad, and provide information services for relevant departments and enterprises.
